Abstract

This essay aims to researching and answering issues of land rights acquisition through improvements to the system of land rights acquisition in Indonesia. The acquisition of land by corporation especially the private corporation in the field oftenly violates the society rights. This violation then makes the writer to analyze 1) analysis how is the responsibility of country in publishing the regulation and 2) how the urgency of applying the first pillar of UNGP in controlling the acquisition of land rights. Using normative legal research as the method of the problem of acquisition of land rights by Indonesian corporation which is analyzed by statute approach, and conceptual approach. The writer found the result that many kinds of conflict and land issues seems never subsided, even it keeps on increasing both the intensity and variety, as it becomes increasingly difficult to owning land and increasing the gap of bargaining position, between the three subjects of development that is government, corporation, and society to own the land rights. Then the writer focused on first pillar of UNGP which country is the first subject as the examples of improvement and expected to reach the second and third subject which is investment company and society. The conclusion of this essay is there are no clear rules yet about protection of human rights and business, this proved from the aspect of policies and decision that issued by the government still giving a crack to the corporation. Therefore, it is important to apply The First Pillar Principal of UNGP into human rights and business arrangements. The writer suggests the improvement of Investment Constitution Number 25 2007, removal of any adverse policies and legitimate RAN (National Action Plan) of Business and Human Rights 2017 about protection of the three subjects as the unequivocal efforts of the state provide legal protection.
