Abstract
Law is made to regulate human behavior at midst of societal life, so that human life is protected the rights. With protected the rights by human life supposed law is orderly, safe, peaceful, peace and prosperous caused by justice and balance. This law writing takes troubleshoot hits straightening law in diploma document forgery doing an injustice completion by Legislative Candidate Member (Caleg) reviewed from Law Substansi, Law Structure, Law Culture, Tool and Infrastructure. Diploma forgery case that involve legislative candidates the total achieves hundreds be form other from intellectual crime. This case can not be assumed as case usually but be called as special crime because involve people message holder candidates and nation pillar that determine good government building and clean. In area Law Polresta Malang that is in the year 2004 found 3 (three) diploma document forgery doing an injustice cases by Caleg that at the (time) of election. Diploma document forgery crime that done by Caleg this regulated in criminal code, Number Law 12 year 2003 about election in paragraph 137 and Number Law 20 year 2003 about National education system in paragraph 67 up to paragraph 69. Law applications effectiveest towards faked diploma use case by Caleg that is applies criminal law under colour of Number Law 20 year 2003 about Sisdiknas and KUHP as Lex Generalis. Faked diploma use doing an injustice element really found in law Sisdiknas and KUHP. Law Sisdiknas serve the purpose of Lex Generalis effectiveest so that Caleg that do faked diploma use doing an injustice is scared, doesn't do action later on day and will make afraid another person to will follow action caleg because Law Sisdiknas has threat of punishment heaviest in comparison with KUHP and election law. In diploma forgery crime tackling efforts in reality at Malang City area not yet ambulatory according to maximal, this matter is caused by obstacle quantity that is faced by Polresta Malang one of them that is tool undercommunication and infrastructure so that must do agreement with other party so that this diploma forgery crime can be overcome.
