Abstract

The election of the Head of Region, either the Governor or the Regent or Mayor, is guaranteed by the Constitution of the 1945 Constitution of the first amendment of Article 22E of the 1945 Constitution with the direct election by the people based on the direct, public, free, secret, honest and fair principles. In practice, it turns out that this has not contributed positively to political learning, and the learning of democracy as well as the good economic impact in realizing the goals of the state administration. There are 3 types of violations in the General Election according to the Law, but in terms of material, there are six types, namely: Violation of criminal election (criminal act of election); Disputes in electoral stages / processes; Electoral administration violation; Violation of the Code; Disputes over election results; and other legal disputes. In the implementation of direct Regional Head Election is not likely to cause a dispute, which one of the forms is a dispute over the results of direct elections. The dispute over the results of the direct Regional Head Election shall be settled in a due process of law including the competent authority. the institution authorized to resolve the dispute over the results of the direct Regional Head Election does not provide legal certainty. The establishment of a special judicial body also does not provide legal certainty, because it is not directly established in Law No. 8 of 2015. Even the provisions of Article 157 paragraph (3) Law No. 8 of 2015 junto Law No. 10 of 2016, does not provide a solution a comprehensive law, as it refers to the Constitutional Court as an authoritative institution. Whereas the Constitutional Court through its decision has declared itself not authorized, because the authority is not regulated in Article 24C paragraph (1) of the 1945 Constitution of the Republic of Indonesia.
