Abstract

This research aims to know a legal attempt from many banks in Indonesia as creditor holder the Authorization Letter of Imposing Beneficiary Right (SKMHT) to cope with the non-performing debtor in KPR subsidy agreement according to The Rule of The Agrarian Minister/Head of The National Land Agency Number 4 of 1996 and reviewing to Mortgage Rights Law. Bearing in mind that SKMHT is just a authorized that can not function the same as a Mortgage Collateral that gives the status of the preferent creditor and it does not have parate execution when debtor default. The issues discussed are about 1)How the implementation of parate execution in KPR with SKMHT Collateral in Bank BTN Surabaya according to The Rule of The Agrarian Minister Number 4 of 1996 and reviewing to Mortgage Rights Law; 2)What are the factors that support and hinder the execution with SKMHT Collateral in Bank BTN Surabaya. Approach method used is empirical method that is see the law in real terms and implementation the law in society. results obtained from this research is 1) The implementation of parate execution in KPR with SKMHT Collateral in Bank BTN Surabaya is with the increase the status of SKMHT collateral to Deed of Assignment Rights (APHT) and next is immediately registered as a Mortgage Certificate and then do the execution of mortgage by Selling Under The Hands or Auction with KPKLN Surabaya; 2) The implementation of parate execution in KPR with SKMHT Collateral in Bank BTN Surabaya runs well and operational because of the supporting factors of the parties who behave cooperativelt and obey the rules, and than the factors hinder are debtor makes misappropriation of credit funds, debtor has not yet vacated the house, object to be auctioned less marketable, object to be auctioned in severe damage.
