Abstract

Along with the development of the times and in the midst of multidimensional crisis, legal life shows the phenomenon of legal uncertainty and injustice, it is often found that law enforcement officers especially advocates in carrying out their duties violate the Code of Conduct, and related to the imposition of sanctions until now still can be said not effective based a field fact that mentions regional honorary councils has no executive nature then for that, the writer will discuss with 2 (two) formulation of the problem as follows: (1) What are the factors causing violation of profession code of advocate. (2) How effectiveness of sanction imposed on advocate if violating code of ethics based on law number 18 year 2003 about advocate and code of ethics of indonesian advocate, as for method used in research of this paper by using approach method of Socio legal Research, and using data source primary and secondary. From the research result, it can be concluded that the factors causing violation of advocate code of ethics especially in East Java Province are caused by 2 (two) factors: external and internal factors, this has not yet been seen as effective due to the weak coordination among Advocates' professional institutions to cooperate with each other to realize the effectiveness of sanctions that have been dropped by other institutions.
