Abstract

In the implementation of providing compensation money to PKWT workers according to public law, statutory regulations require employers to provide compensation money to workers whose work period has ended or the work they have completed has resulted in the end of the employment relationship between the two. However, what about workers whose employment ends before the employment agreement ends. What are the rights of workers when viewed from the perspective of employment law, the application of which adheres to two forms of law, namely private and public. The method used in this research is the sociological juridical (empirical) method, namely obtaining legal knowledge empirically using data collection techniques through observation of the target object, interviews, literature studies, and also internet websites. This research produces several conclusions First, that the implementation of the agreement that occurs is made by continuing to follow the construction ordered by statutory regulations and in its implementation it remains in accordance with existing provisions. Second, When viewed from the aspect of the factors causing the end of the work agreement before the work agreement ends, it is caused by two factors, namely the employee factor and the employer factor which causes this incident to occur. Third, workers whose work period ends before the work agreement ends do not receive compensation money unless the work agreement ends due to the death of the worker, in the case of workers whose work term has ended or the work they have completed, the compensation money is also not received because the compensation money is not given at the end but during the execution of the employment agreement. It is hoped that suggestions from this research will take into account various perspectives in implementing the agreement. Furthermore, the parties are expected to always strive for a good and professional working relationship and pay attention to the signs provided by the government.
