Abstract
The mother who has killed her baby is a kind of criminal act that needs a seriously attention, since in the side of law this kind of act considering to break the law and it is a kind of violence act, whereas from the religion point of view and society norms it is also birth contradiction. As juridical, the crime act of mother to kill her baby in the time of birth or a short time after birth are arranged in Article 341 and Article 342 of Criminal Code, and the organized sanctions toward those kinds of act are imprisonment, with variation of its length. Kind of research that used in this research is law research of Juridical Sociologic. The primary data are collected by interview and are analyzed by Principal analysis and Philosophical analysis. The research result shows that factors of the mother has done those kinds of crime acts toward her baby are: factor of being pregnant because having fornicating, economic factor, and worry about being known to have the baby. Such effort to solve this mother’s crime act who is killing her baby in order to be not repeated based on those kinds of factors are: the woman in order to be not having done such fornicating, the woman has to use intrauterine device that is more save in order to be not being pregnant, they have to be always careful, and their parents should care tightly for their daughter. Besides, it also can be done through increasing the society economic condition by productivity woman training, improving the role of such institution and Woman Concern Institute in looking for woman who is weak either as economically, physically, mentally, and socially. The last ways are to increase the training toward woman who becomes a victim of such crime act and to give such law protection for woman of crime act’s victim.
