Abstract

The violation case about religion insulting had been often times occurred in Indonesia; one of them was at Batu Town. It was axpected the government joint in creating religious community harmony and there was no discrimination for minority community anymore because implementation of rule was not running well and multi interpretation of the rule. the problem formulation of this research: 1. How the effort of local government Batu town in creating Ministers Collective Rule No. 8 and No. 9 year 2006 by Ministers of religious and Ministers of internal Affairs and also giving comprehension toward community about the important of religious community harmony? 2. How Effective the Application of Ministers Collective Rule No. 8 and No. 9 year 2006 by Ministers of Religious Affairs and Ministers of Internal Affairs at Batu Town? the mthod use in this research was approach method of juridical sosiologic by interview with several responders who really needed on writing thesis and observation directly to take primary data, then to be analyzed as descriptive. on the local government office Batu Town, head of Religious Community Harmony (KUB) Community Prosperity (KESRA), Department of Religious Affairs (DEPAG), Religious Figures and head of religious Community Harmony Forum (FKUB) Batu Town. To look for data which become causal factor the violation and implementation of Ministers Collective Rule between Ministers of Religious Affairs and Ministers of Internal Affairs No. 8 and No. 9 year 2006 about Cultivation of Religious Community Harmony (KUB), Socialization of Religious Community Harmony Forum (FKUB) and Establishment House of Worship at Batu Town. The conclusion, lack of religious activity control that collected many people by law officer, particularly control in the field, government has to reviewed Ministers Collective Rule (PBM) based on needed of others religion that need house of worship suitable with religious sect, thus minority community was not gave discrimination anymore by current rules and social jealously that able to make conflicts like occurred so far in Indonesia. Suggestion, Ministers Collective Rule (PBM) has to be revised, appropriated with pluralism spirit and religioussty Indonesian people
