Advanced growth of civilian that one of the main factor from the human resource moreness in common growing some human resource problem such as the wideness of work opportunity. Feeling less on getting attention from the government the effect is quite affected by a lot offside, that the un seriously on handling this problem. So lots of WNI (Warga Negara Indonesia) that wants to change their fate in the other country with working as TKI (Tenaga Kerja Indonesia) even this problem ready to face them. This program is one of solution that offered by the government to fight the unemployment number that has been increasing. Because of that, in this thing the writer wants to approaching a problem related with license offering procedure by PJTKI (Perusahaan Jasa Tenaga Kerja Indonesia) on placing the TKI (Tenaga Kerja Indonesia) to the foreign country, the form of watcher director, the law consequence if placement license violation of TKI on foreign country. For straighting and perfection in direction of offering a license on the case of placing TKI is a thing that wanted by lots of side even from the TKI side it self and give one point plus from the public face that government able to directing straightly and perfectly like what we all wishes and completed by a professional attitude from each of person/department that have authority in this case. But for aiming to the high level of perfection must not missed from obstacles that approaching that can be a problem and slowing this directing it self. To able to finish this duty (PJTKI) which in this thing is the director of placing some work to TKI, first PJTKI must have a license letter that on company register license letter form and visually called by SIUP. Beside of that after SIUP has been given PJTKI it self must have a director license of placing TKI that has been recognize with SIPPTKI which is a license to doing up recruitment on TKI candidat in locals placed. After the SIP has been given PJTKI with agreement from Nakertrans able to doing TKI recruitment in local place according to their own local recruitment place that in advanced will directing by the vice office the central PJTKI. With directing the recruitment of TKI, it means that need a government act on this thing here is BNP2TKI that according with it authority doing guardian. This guardian on this thing is in process of placing the TKI, that match with the rules, inside of it has been cleaned that guarding start since from the start of recruitment,taking care, document, training, education, placement, and departing need, departing goes to the destinate country, until they coming back from that country. According the guardian aiming is to detect from start of violation that doing by the side that placing the TKI. So if the violation happen BNP2TKI as the side that have full authority indirecting the TKI place must take action in rush with giving punishment and the punishment that has been given it can be a administration punishment or jail punishment if it can’t be tolerated again. Locking that a lots of opportunity or pit that can be used by someone that doesn’t want to take responsibility BNP2TKI must act as a government un department can corrected from each violation that ever happen. Suggest minister decision about human resource and transmigration No. 104A thn. 2002 especially on section 29 (1) must immidiactly have a revision and matching, because based on the result of evaluation every TKI coming back showing that the existing of making a placing deal or working together still in form of mouth to mouth and not in the legal rules.
