Abstract

Access to justice is citizen rights which should be fulfilled by Country which based on the Law. The research had statement of problems : (1) What kind of Access to Justice needed by Malang City society ; (2) What kind of access to Justice role by Law Assistance Institution (Lembaga Bantuan Hukum – LBH) Surabaya Post Malang ; (3) What kind of inhibition faced by LBH Surabaya Post Malang in order to increase access to justice for Malang City Society. Method used in this writing is juridical sociologist, the discussion lined with law theory also seeing reality in society. Data collected were primary data through interview and documentation, also secondary data through library study. The final assignment aimed to find out access form to justice needed by Malang Citizen, whether in litigation or non-litigation, find out the form of access to justice which built by LBH Surabaya Post Malang to arrange the problem, find out the inhibition faced by LBH Surabaya Post Malang in order to increase access to justice of Malang Citizen. Arrangement and Solution of cases at LBH Surabaya Post Malang, could be fulfilled through two ways, they were litigation (in Court) and non-litigation (Outside Court). Access to Justice needed by Malang citizens programmed by LBH Surabaya Post Malang were planning, maintenance, process, and supervising. Inhibition faced by LBH Surabaya Post Malang sourced from people, City Government and Internal of LBH Surabaya Post Malang. The research showed that when there was law violation to the society, it could be arranged by two ways, litigation and non-litigation. Access to justice needed by Malang citizens given by LBH Surabaya Post Malang were planning, maintenance, process, and supervising, beside the justice access needed by Malang City society which role by LBH Surabaya Post Malang. The inhibition came from society, City Government, and Internal of LBH Surabaya Post Malang.
