Abstract
At Malang City, there still a controversy in parking service, consumers often suffer a loss, especially in motor vehicle loss. This research aimed to find out law relation between parties in parking agreement and to find law protection to the parking consumer when losing motor vehicle at Malang City. This research used socio-juridical approach, by purposive sampling technique, where the population chosen were place which had parking service, especially where loss existed. From the population, there were two parking lot as sample, those were Malang Town Square parking and Big Market Matahari parking. Data collection technique was direct observation to the researched object, where the loss existed, also interview with parking server, parking arranger, and consumer who used parking service as primary data object. The data was analyzed by using secondary data which were documentation and literature study. The data then analyzed using qualitative descriptive method. From two parking service area as samples, result concluded that law relation between parties in parking agreement was done by Traffic Department, parking arranger, and parking consumer. The relation created rights and duty also formed responsible to the parking arranger to the consumer when there was loss inmotor vehicle. The business organization also tried to give law protection by giving parking ticket and Vehicle Number checking while the vehicle left the parking area. There could be concluded that though the application haven’t run well, but each parking area at Malang City has given different responsibility while there was motor vehicle loss and also tried to responsible about the case. The writer suggested that the parking arranger should understand Regional Rule of Malang City no.1 / 2002 about Parking Service, so that they would recognize their responsibility of motor vehicle safety when it parked. There should be a special standard in law protection to the parking service consumer in each parking area.
