Abstract

Mark is one of Intellectual Property by Intellectual Property Rights that handled by Directorate General as written in Undang-Undang Nomor 15 Tahun 2001 tentang Merek. Mark registration target is to protect the mark in order that everyone or legal bodies who have a mark for protection and rule of law. This research object is how the implementing of mark registration process of “NS26 NISOKU” for entrepreneurs in city of Blitar and problems faced by mark registration of “NS26 NISOKU” evaluated from Undang-Undang Nomor 15 Tahun 2001 tentang Merek and other Implementing Regulation in getting the mark to mark registration process. This research uses approach method of Sociological Jurisprudence Juridical. The data collecting techniques are interview, documentation and book study with respondent of mark registrant of "NS26 NISOKU" and direct observation to research location at UD. NISOKU City of Blitar as the place of primary data intake. Then it is analyzed descriptively. Research result indicates that registration process conducted by company with trademark "NS26 NISOKU" that is through seminar and exhibition of work results organized by UNAIR. Cost expended in the mark registration is Rp 2,500,000. Whereas problems faced relate to announcement inexistence in mark registration processes either in writing and also oral from Directorate General of Intellectual Equity, too far of place of mark registration and level of cost expended for getting the mark. The conclusion, based on that can be concluded that government should be able to make moderate procedure and process of mark registration, so the process can be quicker and level of cost adapted for condition of society economy.
