Abstract
ABSTRACT The rising of crime cases number done by child caused by very little their parents attention. So, the crime which is done by child will need a law protection in the investigation process which is appropriate with constitution rules. In order to acknowledge children right in every investigation step this observation used by sociologic juridical approach method. The data collection by interview and direct observation in Polresta Malang as a place of primary data interpretation. As the reseach result during investigation proses the child have the right to get defender/lawyer, and the proses must be done informally and closed from public. However, this rules did not fully efefective in Polresta Malang. The investigation have very limited investigation abaout the right of the child well as the number of investigation. The investigation room for child do not apporiate with what the children need. To maximize the implementation of law protection to child as a crime suspect in the investigation process, the writer suggested that the investigation should be given human right training and to build push the local goverment; it needed the government role to give a special room for child which is good. So the investigation process to child can give a familiar impression.
