Abstract

Prisoners are lost people which their personality should be rebuild in order to fit them into community. Therefore it’s an obligation to study for 12 years for citizen and prisoners to increase education quality to lead the prisoners to a better way of life. LAPAS as institute whereby within it’s provides education for prisoners and is expected to fulfil the prisoner rights related with 12 years learning obligation applied. This research had three objectives those were: First, how the implementation of the prisoner rights to get 12 years learning obligation applied in LAPAS first class in Malang which is observed from section 9 Governmental Regulation of Number 32 Year 1999. Second, what is the obstacle factor for the prisoner to pursue their rights related with12 years learning obligation applied? This research used juridical sociology design, the technique used to collect the data by direct observation at the research location of LAPAS first class Malang, as a place to take the primary data, interviewed respondence chosen from the employee of the LAPAS first grade and the prisoners. Afterwards, the result of the research data is analyzed descriptively. From the result of the research, the form of implementation is by carrying out the A, B, and C package, the educators come from the employee and the prisoners and the implementation of the education is based on curriculum. The prisoners who graduated are recognized and certified by department of education. By standard of fieldwork there are certain obstacles of utilities and infrastructure, the curriculum arranged by LAPAS, the incompetence of the educators themselves and still low consciousness of prisoners thought to sence of education. From the conclusion the design of education for the prisoners that can be a solution for 12 years learning obligation applied is A, B, and C package, preparing the educators, proper implementation according to curriculum and certified proof by the department of education for the prisoner who graduated. The factor of obstacles is utilities and infrastructure, the curriculum arranged by LAPAS, the incompetence of the educators themselves and the lack of educational funding.
